Before you File Chapter 7 Bankruptcy
Credit Cards.
Stop using credit cards immediately once you have decided to
file bankruptcy. If you have charges or cash advances
in the months preceding filing bankruptcy, the creditor
may file an adversary complaint alleging that you
incurred recent charges with fraudulent intent and
without the intent and/or ability to repay these debts.
Credit Report. You must
obtain a
credit report and furnish a copy to me to
ensure that all debts, collection agencies, and judgments are listed
properly in your bankruptcy. Credit reports also reveal if a debt was
bought or sold. If you have recently been denied credit, you are
entitled to a free credit report from the reporting agency. A recent
change in federal law gives you the right to obtain a free credit report
once a year from all three primary credit reporting agencies.
Not all debts are listed on credit reports. Make a list of
any debt that does not appear on your credit report. Old debts,
buy here pay here type auto repossessions, evictions, and medical bills
are frequently left off. Addresses for these creditors can be
found in the phone book and online. They must include the zip code.
Credit Union Loans. You should examine your loan
documents or talk to your credit union if you are unsure whether or not
your credit union loan is secured by money in other accounts. Many credit
unions also “cross-collateralize” loans, which means that a credit card
account may be secured by other property such as your bank account or
automobile.
