Purchasers
The debt collection agencies listed below habitually violate the Fair
Debt Collection Act and the Fair Credit Reporting Act. Many do not have
evidence that you owe a debt and violate the law by aging debts or
failing to remove debts from credit reports. Never give a debt
collector your bank account number, credit card number, or any other
personal information.
Arbitration awards issued by the National Arbitration Forum
According to many courts throughout the country, the arbitration awards
issued by the National Arbitration Forum aren't worth the paper they're
printed on. If you being sued to enforce an arbitration award, you
should hire an attorney to file a response to the lawsuit immediately.
Fraudulent Affidavit's of Debt or Statement of Debt.
Most debt collectors & debt purchasers DO
NOT have a copy of the original contract you signed that states the
terms, conditions, interest rate, and misc. charges such as late charges
& over limit charges. This is the ORIGINAL contract you signed when you
first received your credit card. They usually don't have any other
proof you owe the debt either such as a billing statement.
If you are being sued by a debt
collector or a debt purchaser that has attached an affidavit of debt or
statement of debt as "evidence" that you owe a debt, you should hire an
attorney immediately.
No Corporate Filing.
Debt
purchasers often weave such a tangled web of deceit they neglect to file
corporation papers with the Florida Secretary of State's office. All
companies must do a Secretary of State corporate filing to conduct
business.
